To be clear, whether you are using our opt-out or an online industry opt-out, these cookie-based opt-outs must be performed on each device and browser that you wish to have opted out. Advertisements on Third Party websites that contain the AdChoices link may have been directed to you based on information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes.

Although Strive makes good faith efforts to provide individuals with access to their personal information, there may be circumstances in which Strive is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question or where it is commercially proprietary. Strive will retain personal information for as long as needed to provide Services or as otherwise permitted by law. Strive will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We consider the protection of all personal information we receive as critical. Please be assured that we have security measures in place to protect against the loss, misuse, and alteration of any personal information we receive from you. As with any transmission over the Internet, however, there is always some element of risk involved in sending personal information. 9. CHILDREN’S PRIVACY

We need to collect your and your child’s Personal Data to provide our services to you and your child. We are committed to protecting the privacy of children who use our sites and applications. Whenever we refer to a “child” in this privacy policy, we mean a child under the age of 13 for US, UK and Singapore users, under the age of 16 for EU users. Please be aware that to protect children’s privacy and security, we will take reasonable steps to verify a parent or legal guardian’s identity before granting access to any personal data.

9.1 EU Child Users

If your child is a resident of a Member State of the European Union, we will treat their Personal Data as a child’s Personal Data if they are under 16 years of age, and receive consent of the holder of parental responsibility as required for the processing of Personal Data. All residents of the European Union further have specific rights granted by the General Data Protection Regulation (“GDPR”).

9.2 How do we secure your and your child’s Personal Data?

We are committed to protecting your and your child’s Personal Data in our custody. We take reasonable steps to ensure appropriate physical, technical and managerial safeguards are in place to protect Personal Data from unauthorized access, alteration, transmission and deletion. We ensure that the third parties who provide services to us under appropriate contracts take appropriate security measures to protect Personal Data in line with our policies.

9.3 How long do we keep your and your child’s Personal Data?

We keep the Personal Data we collect about you and your child for as long as it is required for the purposes set out in this Privacy Notice and for legal or regulatory reasons. We may take reasonable steps to delete or permanently de-identify your Personal Data that is no longer needed.

10. INTERNATIONAL USERS

11. CALIFORNIA PRIVACY RIGHTS

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. Strive does not share personal information with third parties for their own marketing purposes.

In addition, you may lodge a complaint with a data protection supervisory authority if you believe that your data protection rights relating to your personal data have been breached by Strive or that your personal data has been compromised in some way. 13.2 Compliance

This Policy shall be implemented by Strive and all its operating divisions, subsidiaries and affiliates. Strive has put in place mechanisms to verify ongoing compliance with Standard Contractual Clauses and this Policy. Any Employee who violates these privacy principles will be subject to disciplinary procedures.

15. DEFINITIONS

The following capitalized terms shall have the meanings herein as set forth below.

Agent” means any Third Party that Processes personal information pursuant to the instructions of, and solely for, Strive or to which Strive discloses personal information for use on its behalf.

Employee” refers to any current, temporary, permanent, prospective or former employee, director, contractor, worker, or retiree of Strive or its subsidiaries worldwide.

Process” or “Processing” means any operation which is performed upon personal information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

Sensitive Data” or “Sensitive Personal Information” is a subset of personal information which, due to its nature, has been classified by law or by policy as deserving additional privacy and security protections. Sensitive Personal Information includes personal information regarding EU residents that is classified as a “Special Category of Personal Data” under EU law, which consists of the following data elements: (1) race or ethnic origin; (2) political opinions; (3) religious or philosophical beliefs; (4) trade union membership; (5) genetic data; (6) biometric data where Processed to uniquely identify a person; (6) health information; (7) sexual orientation or information about the Individual’s sex life; or (8) information relating to the commission of a criminal offense.

Standard Contractual Clauses” is a data transfer mechanism described in Article 46(2)(c) of the General Data Protection Regulation (GDPR) and approved by the EU Commission Decision 2010/87/EU on February 5, 2010 and includes any successor standard contractual clauses that may be adopted pursuant to an EU Commission decision.

Third Party” is any company, natural or legal person, public authority, agency, or body other than the Individual, Strive or Strive’s Agents.
